Interim order of Supreme Court that local level cannot collect tax on highways
Kathmandu. The Supreme Court has issued an interim order to stop the tax and road usage fee collected by the local level from vehicles operating on national, subsidiary and postal highways. The court gave this order while hearing the writ petition filed by Rajendra Bikram Baniyan, the president of Nepal Truck Transport Association, as an opponent to the Prime Minister and Council of Ministers Office Singhdarbar on August 22.
Judge Mahesh Sharma Paudel and Judge Balkrishna Dhakal were present in the joint bench. Senior advocate Uddhav Prasad Chaulagain and advocate Vakil Prasad Gautam argued on behalf of the petitioner. Kailash Khatri, Deputy Attorney General of the Prime Minister and Cabinet Secretariat, argued on behalf of the opposition. Advocate Bidyadevi Katuwal and Jeevan Bahadur Basnet were present on behalf of Jitpur-Simra sub-metropolitan city.
In the petition, the local level was accused of collecting road usage fee and tax from the vehicles in an unauthorized manner and it was requested to issue an interim order to stop it immediately.
