With the agreement of seven points between the National Independent Party and the Mayor of Kathmandu Metropolitan City, Balendra Shah Balen, it is now seen that the post of Mayor of Kathmandu Metropolitan City will be vacant. According to the agreement, Balen will become a candidate for the post of MP in the House of Representatives elections to become the Prime Minister.

According to the constitution and the legal system, the elected people's representative of the local level cannot be a candidate in the next election without resigning from his position. According to the law, if any elected representative of the local level wants to be a candidate in the next election, he must be vacated on the day of nomination.

With the resignation of Balen, the post of head of Kathmandu metropolis will be vacant. According to the constitution, in the event that the post of head or deputy head of a metropolis, sub-metropolis or city executive is vacant, if the term of the post is left for one year or more, the post will be filled by by-election.

The government has scheduled the election of the House of Representatives for February 21. Which means that Balen has to resign from the post of mayor of Kathmandu before that, ie before registering his candidacy for that election. Since the election of the mayor of Kathmandu was held at the end of Baisakh 2079, if this position becomes vacant within the next Baisakh, there will be at least one year of tenure left, so a by-election should be held.
