Vehicle accident: You cannot be sent to jail if you cannot pay compensation and medical expenses

Kathmandu. The Supreme Court ruled that it is illegal to imprison the accused on the basis of not being able to pay the bond demanded for the purpose of paying the medical expenses, transportation expenses and compensation for the victims of the road accident. The full bench of the Supreme Court has set such an important example while hearing the 'Bandi directikaran' writ. The full bench of judges Hariprasad Phuyal, Kumar Regmi and Balkrishna Dhakal delivered the verdict on 24th January 2082.

In the year 2081, a motorcycle accident occurred in Suvarna rural municipality of Bara district. The motorcycle was requested by Rajkishore Prasad Yadav and was driven by Rakesh Das. The motorcycle hit 70-year-old Satyanarayan Thakur, who died during treatment.

There were two parallel cases in this case. First, in District Court. Bara District Court ordered Rajkishore to be released on 15,000 bail in the vehicular manslaughter case. He posted bail and remained in custody.
