The way was opened for Trump to deport 7000 Nepalis who have residence permit in America

Kathmandu. A US court has allowed the Trump administration to deport Nepalis who have been granted permission to stay in the US under the Temporary Protected Status (TPS). The Ninth Circuit Court of Appeals has issued an order allowing the US government to proceed with a decision to end Temporary Protected Status for immigrants from Nepal, Honduras and Nicaragua. About 7 thousand Nepalis are living in America under TPS.

The three-jude panel's decision overturned a December 31, 2025, order by a federal district court in San Francisco. That day, US District Judge Trina L. Thompson ruled that the DHS Department of Homeland Security's decision to end TPS violated the Administrative Procedure Act and ordered that those decisions be overturned.

The district court held that DHS did not properly consult with the State Department and did not explain why it deviated from previous humanitarian assessments. That initial order temporarily barred DHS from terminating TPS and maintained TPS protections and work permits.
